THE TERMS AND CONDITIONS OF THE ELECTRONIC SOCIAL INNOVATION INFORMATION SYSTEM

I. GENERAL PROVISIONS

1. The terms and conditions of the electronic Social Innovation Information System (hereinafter ‘the Terms and Conditions’) regulates the procedures for accessing the electronic Social Innovation
    Information System (hereinafter ‘eSINNIS’), and for submitting and retrieving data via eSINNIS.

2. ‘User(s)’ shall mean persons registered in eSINNIS who are entitled to perform the actions set out in the Terms and Conditions.

3. The European Social Fund Agency (hereinafter 'the Agency') is not liable for any hardware, software, products and services of third parties (such as telecommunication equipment, internet connections,
    operating systems and internet browsers) that may prevent an eSINNIS user from accessing eSINNIS and submitting data in a timely manner, or for any loss or corruption of data due to such failures.

II. SUBMISSION OF DATA, APPLICATIONS AND DOCUMENTS

4. Only registered users can access eSINNIS. To register, a person must fill in eSINNIS registration form at https://esinnis.eu. To complete the registration, the person must confirm that they agree explicitly
    to the Terms and Conditions and consent to the processing of personal data (Annex 1 to the Terms and Conditions) available on eSINNIS and providing assurance that the organisation has granted them
    the right to apply. Confirmation by the person that they have read the Terms and Conditions and the consent regarding the processing of personal data entitles them to submit an application. After
    submitting the application, the person shall be entitled to receive and send notifications relating to his or her application.

5. User is responsible for all actions carried out in eSINNIS using email and password provided during registration (even when those actions have been carried out by others who are using the user’s email
    and password).

6. Users shall fill in the application form for a specific call and upload the mandatory and other (if any) annexes (as specified in the call conditions).

7. User may assign other users who will have access to the application, however, the user who created (started submission of) the application is responsible for the entire application and its submission.

8. Before an application is submitted, it is verified. An application is considered verified if it has been completed in accordance with the technical requirements, mandatory annexes (a list of mandatory
    annexes is specified in Annex 4 to the relevant call conditions) have been uploaded, and if the deadline set in the call conditions has not expired.

9. If the application is completed correctly, and no error list is provided, the application with attached annexes is submitted to the Agency via eSINNIS.

10. If the application is completed incorrectly, a list of errors is produced. Once all errors in the application have been corrected, user resubmits the application for verification. The process resumes from the
      steps set out in points 8 and 9 of the Terms and Conditions.

11. After submitting the application, users shall receive a confirmation that their application was successfully submitted and registered.

12. An application can be submitted via eSINNIS only before the deadline of the call concerned. An application cannot be submitted after the deadline specified in the call. If, due to technical issues,
      eSINNIS allows an application to be submitted after the deadline, the application will not be accepted.

13. A user can amend an application already submitted in eSINNIS before the deadline for submission of applications specified in the relevant call conditions.

14. An application with mandatory and other (if any) annexes may no longer be removed from eSINNIS, once they have been submitted.

15. To withdraw a submitted application after the deadline, user shall send a free-form message to the Agency via eSINNIS requesting the withdrawal of the application. Once the Agency confirms the
      withdrawal of the application, eSINNIS user receives a notification. A withdrawn application will not be assessed and cannot be replaced.

16. Users must ensure that personal data (uploaded into eSINNIS) are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the
      protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter ‘the GDPR’), also with other data
      protection legislation and interpretations by the competent authorities. By uploading personal data, users confirm that they are authorised to transfer personal information of other persons.

17. The Agency shall handle the personal data within eSINNIS in accordance with the GDPR, other data protection legislation, and interpretations by the competent authorities. Information on the processing
      of personal data by the Agency is published in eSINNIS.

III. COMMUNICATION BETWEEN THE AGENCY AND eSINNIS USERS

18. All communication, data and documents shall be submitted via eSINNIS.

19.The date and time of receipt of information via eSINNIS shall be deemed to be the date and time of its submission to eSINNIS.

20. Communications in eSINNIS are generally considered:

          20.1. to have been made when they are sent by the sending party (i.e. on the date and at the time they are sent through the eSINNIS, as indicated by the time logs),

          20.2. to have been received when they have been received by the receiving party (i.e. on the date and at the time they were received via eSINNIS as indicated in the time logs).

21. Notifications that have not been accessed within 10 days after sending are considered to have been accessed.

22. Information about a new message received in eSINNIS shall be sent to the e-mail address provided by the user. The user can access the message by logging-in into eSINNIS.

23. A document sent or notified via eSINNIS is considered as equivalent to a paper document, is admissible as evidence in legal proceedings, is deemed original and enjoys the legal presumption of
      authenticity and integrity, provided it does not contain any dynamic elements capable of automatically changing it.

24. If support is needed, users can contact the Agency via eSINNIS Communication module or look up the information in the manual.

IV. CHANGES TO THE TERMS AND CONDITIONS

25. The Agency may, at any time, vary, add to or delete any provision of these Terms and Conditions.

26. Users acknowledge and agree that such new Terms and Conditions enter into force with their publication on eSINNIS. Continued use of eSINNIS after any changes shall constitute users’ consent to
      changes. User can review the most current version of the Terms and Conditions at any time at eSINNIS.

27. Users are responsible for regularly verifying the applicable Terms and Conditions.

V. FINAL PROVISIONS

28. If the application is selected for funding, the Coordinator‘s legal representative will be asked to provide additional documents to identify the person who will sign the Grant Agreement. The user will be   
      informed about the exact documents to be provided by a separate eSINNIS message.

29. The Grant Agreement will be fully managed electronically through eSINNIS.

30. eSINNIS documents and data shall be processed and stored in accordance with the Law of the Republic of Lithuania on Documents and Archives and its implementing legislation.
